LICENSE AGREEMENT FOR FXIT Software Products

*** License Agreement *** April 04, 2003

- FULLY FUNCTIONAL TIME LIMITED SHAREWARE VERSION - 30 DAYS TRIAL PERIOD - AFTER THE TRIAL PERIOD EXPIRES, A PAID LICENSE NEEDS TO BE PURCHASED TO KEEP THE PROGRAM RUNNING.

- Thank you for using WWW.FXIT.COM.AR products. Please take the time to read this License Agreement, and feel free to contact us through e-mail at INFO@FXIT.COM.AR should you need any further clarification regarding the present Agreement. You must refrain to install and/or use this program if you do not understand or agree with this Agreement or part of it.

- You should carefully read the following terms and conditions before using this software. Your use, installation or attempt to install this program indicates your understanding and acceptance of this License. If you do not agree to any of the terms of this License, then do not install or use this copy of the program. By using this program you agree to be bound by the terms of the License Agreement as stated in the originally enclosed License.txt file and in the License Agreement section of our website. Any breach of this Agreement shall result in immediate and automatic termination of this License and may result in criminal and/or civil prosecution. You or the User refer indistinctly to the same person.

- Program is not sold, it is the exclusive property of WWW.FXIT.COM.AR and it is Licensed by WWW.FXIT.COM.AR to be used by one person in a single computer under the terms of this License Agreement. The program is protected by Copyright Laws, International Treaties and its provisions. Should hardware change from the original one where the program was installed, you may need to purchase a new License key. All copyrights to this program are exclusively owned by WWW.FXIT.COM.AR. This is a non-exclusive license.

- This is a fully functional time limited shareware version that can be used for free during a trial period of 30 continuous days after its installation by any user in any computer. It is not free software. After the trial period expires, the program will stop working and you are no longer authorized to use it. If you wish to keep using it, a License Key has to be purchased from WWW.FXIT.COM.AR or their duly authorized agents.

- You may not sell, donate, rent, lease, lend, modify, reverse engineer, decompile, disassemble or create derivative or direct works based on this program or any of its components. Any such unauthorized use shall result in immediate and automatic termination of this License and may result in criminal and/or civil prosecution.

- You are authorized to distribute unmodified exact copies of the program installation file in any way as long as the program and any of its components are in a non-modified state, including this License Agreement. You are specifically prohibited from charging, requesting donations, or any kind of reimbursements for any such copies or distribution -however made- and from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission by WWW.FXIT.COM.AR.

- This Agreement shall be governed by the laws of the province of Buenos Aires, Argentina.

- The purpose of providing a time limited fully functional version for the trial period of 30 days is to allow the user to fully decide over the suitability, usefulness and/or performance of the program for the user's purposes, as well as to test its compatibility with the user's hardware. For that reason we CANNOT GRANT AND DO NOT MAKE ANY REFUNDS, even if the License Key was purchased before the expiration of the trial period.

- WWW.FXIT.COM.AR reserves the right to change the specifications of this software at any time without prior notice.

- You may not use this program, any of its components or the data processed by it for unlawful purposes. You cannot use this program in jurisdictions where its use is considered illegal by the local laws. Any such unauthorized use shall result in immediate and automatic termination of this License and may result in criminal and/or civil prosecution. You agree to be accountable for, and to hold WWW.FXIT.COM.AR harmless from any claims or losses relating to the use of this program for such specifically unauthorized purposes.

- This program may not be used or exported where US export restrictions apply.

- THE SOFTWARE AND ALL ACCOMPANYING FILES ARE PROVIDED "AS-IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESSED,IMPLIED OR OTHERWISE, INCLUDING AND WITHOUT LIMITATION TO, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL WWW.FXIT.COM.AR, THE AUTHORS, ADVISORS OR THE DISTRIBUTION AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, CIRCUNSTANCIAL, CONSEQUENTIAL OR ANY OTHER FORM OF DAMAGES WHATSOEVER (INCLUDING AND NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, LOSS OF PROPERTY, LOSS OF LIFE, DISABILITIES, OR ANY OTHER LOSS OR DAMAGE), WHETHER OR NOT WWW.FXIT.COM.AR WAS ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE, MISUSE, INABILITY TO USE, INSTALLATION OR UNINSTALLATION (OR THEIR ATTEMPTS) OF THIS SOFTWARE OR ITS COMPONENTS.

Good data processing procedure dictates that any program has to be thoroughly tested with non-critical data and results checked-out for accuracy before relying on it. The user must assume the entire risk of using the program and uses the software at its own risk. You agree to hold WWW.FXIT.COM.AR harmless from any claims or losses relating to this.

ANY LIABILITY OF THE SELLER OR THE PRODUCER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT.

*** Privacy ***

We are committed to Privacy. Our customers' and any other's parties e-mail, or any other data supplied directly to us during any enquire, sale, transaction, or communication we keep it only for ourselves. We do not let or have anyone authorized to pry on or use this data. We believe the privacy polices of our vendors match our own, however we invite to check our vendors' privacy policy before submitting any data to them, and chose the one of them that you feel will protect better your privacy.

*** Sales ***

We process our sales through vendor sites, that offer SSL encryption type security for credit card transactions through the Internet, as well as phone and fax sales. The transaction is made under the terms of the vendor site that provides it. You may check each vendor site policies regarding sales and privacy. FXIT may sell directly if the customer is not satisfied with the vendor site policies, however, an extra processing fee will be assessed for administrative duties, shipping and handling, data processing, etc.

*** Upgrades ***

Presently, all upgrades within a major version (e.g. 2.xx to 2.yy) are free of charge. There is a small fee for upgrades between major version (from 2.xx to 3.yy), though there are no values or a schedule to that yet.
